4.2 If we are unable to accept your order, we will inform you of this in writing and will not charge you for the Goods. This might be because the Goods are out of stock, because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the Goods.
4.3 You will be responsible for payment of any import duties and taxes for deliveries outside of the United Kingdom. Please contact your local customs office for further information before placing your order.
4.4 You must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable or responsible if you break any such law.

You may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on this Web Site or unless given express written permission to do so by the relevant manufacturer or supplier.
9. Links to other web sites
This Web Site may contain links to other sites. Unless expressly stated, these sites are not under our control or that of our affiliates and are provided for your information only. Your use of those sites is subject to the terms of use and policies available on those sites. We have no control over the contents of such sites and accept no responsibility or liability for them or for any loss or damage that may arise out of your use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.
10. Links to this Web Site
If you wish to place a link to this Web Site on other sites you may do so only to the home page of this Web Site and with our prior permission. Deep linking (i.e. links to specific pages within this Web Site) requires our additional express permission. To find out more please contact us by email at: sales@jbpackaging.co.uk.
11. Providing the Goods
11.1 We will deliver the Goods to you via a third party courier service at your cost. Alternatively, you may collect certain Goods directly from us, as detailed on our Web Site.
11.2 The estimated time frame for delivery of the Goods within the United Kingdom is 2 – 4 working days.
11.3 The costs of delivery will be as displayed to you on our Web Site.
12. Faulty, damaged or incorrect Goods
12.1 We are under a legal duty to supply Goods that conform to our contract with you, including applicable requirements concerning satisfactory quality, fitness for purpose and correspondence with their description.
12.2 Please inspect your order after delivery and contact us as soon as reasonably possible if Goods are faulty, damaged, incorrectly supplied or not as described. Provide your order number or other proof of purchase and details of the issue. Photographs can help where available. Please retain the Goods and packaging while we provide instructions.
12.3 We will provide an appropriate remedy in accordance with your applicable legal rights. Depending on the circumstances, this may include a refund, replacement or repair. Your entitlement to a statutory remedy is not subject solely to our discretion.
12.4 Consumers normally have a 30-day short-term right to reject faulty or misdescribed Goods for a refund. Further rights, including rights to repair, replacement, price reduction or a refund, may apply afterwards.
12.5 We will arrange collection or reimburse reasonable return transport costs where applicable. Please contact us before arranging transport so that we can agree suitable arrangements. Unless we provide another address, Goods should be returned to the address in clause 13.5.
12.6 Refunds will be made to the original payment method without a refund fee, without undue delay and within the applicable legal deadline. For Consumers entitled to a refund for defective Goods, we will issue it within 14 calendar days after agreeing that entitlement.
12.7 The change-of-mind conditions and time limits in clause 13 do not limit your applicable rights concerning faulty, damaged, misdescribed or incorrectly supplied Goods.
13. Cancelling your order, returns and refunds
13.1 Our voluntary 30-day returns policy
13.1.1 You may request a change-of-mind return of unused standard Goods within 30 calendar days after delivery. You then have a further 14 calendar days after notifying us to send the Goods back.
13.1.2 This voluntary policy applies to Consumer and business customers purchasing through our Web Site, including purchases of discounted standard Goods.
13.1.3 Goods returned under this voluntary policy must be unused, clean, undamaged and suitable for resale. Goods used to store or transport food or other contents are not eligible for voluntary change-of-mind returns.
13.1.4 Please retain original packaging where possible. Opening packaging solely to inspect Goods does not automatically prevent a return.
13.1.5 These voluntary conditions do not restrict Consumers’ statutory cancellation rights under clause 13.2 or applicable rights under clause 12.
13.2 Consumers’ statutory cancellation rights
13.2.1 If you are a Consumer, you normally have a statutory right to cancel an online order without giving a reason, subject to the exceptions in clause 13.3.
13.2.2 You may cancel from placing your order until the end of 14 calendar days after delivery. For an order consisting of multiple Goods, lots or pieces delivered separately, this period normally runs from delivery of the last item, lot or piece.
13.2.3 Notify us of cancellation before the deadline and send the Goods back within 14 calendar days after notifying us, unless we agree to collect them.
13.2.4 You may inspect Goods as you would in a shop. Original packaging is not a condition of exercising your statutory cancellation right. Where legally permitted, we may deduct an amount for loss in value caused by handling beyond what is necessary to establish the Goods’ nature, characteristics and functioning.
13.2.5 Any clear statement of cancellation is sufficient. You do not need our approval or have to use a particular form. The optional cancellation form is provided in clause 24.
13.2.6 A statutory cancellation is effective if your notification is sent before the cancellation deadline. The deemed-receipt provisions in clause 22 do not postpone or restrict this right.
13.3 Exceptions to change-of-mind cancellation
13.3.1 Goods genuinely made to your specifications or personalised for you are excluded from change-of-mind returns.
13.3.2 Other statutory exceptions may apply to Goods liable to deteriorate or expire rapidly; sealed Goods unsuitable for return for health protection or hygiene reasons once unsealed; and Goods that become inseparably mixed with other items after delivery.
13.3.3 Any applicable exclusion will be disclosed before purchase. Goods are not treated as bespoke simply because they are ordered in bulk or manufactured after an order is placed. Selecting standard catalogue options does not, by itself, make Goods bespoke.
13.3.4 These exceptions do not affect applicable rights concerning faulty, damaged or misdescribed Goods. Merely opening a standard packaging product does not automatically create a hygiene exception.
13.4 How to arrange a return
13.4.1 Email sales@jbpackaging.co.uk, call 0800 285 1339 or write to the address in clause 13.5. Provide your order number or other proof of purchase, the Goods and quantities being returned, their condition and the number of parcels or pallets.
13.4.2 Please contact us before sending Goods back so that we can provide instructions, particularly for pallet orders or large consignments. This request does not make a Consumer’s statutory cancellation conditional on our approval.
13.4.3 Package Goods securely and retain proof of dispatch.
13.5 Return address
Unless we give you another address, send returns to:
JB Packaging / Engineered Foam Products Ltd
Cornhill Close
Lodge Farm Industrial Estate
Northampton
NN5 7UB
13.6 Return transport costs

13.6.5 Return transport costs for faulty, damaged or incorrectly supplied Goods are dealt with under clause 12.5.
13.7 Refunds for cancellation and change-of-mind returns
13.7.1 We will refund the amount paid for eligible returned Goods to the original payment method, without an administration or restocking fee.
13.7.2 Refunds will be issued without undue delay and within 14 calendar days after receiving the Goods back.
13.7.3 For Consumers exercising statutory cancellation rights, the deadline runs from receipt of the Goods or evidence that they have been sent back, whichever is earlier.
13.7.4 If you cancel before delivery and no Goods need returning, we will refund within 14 calendar days after notification of cancellation.
13.7.5 When your entire eligible order is cancelled or returned, we will also refund the original standard delivery charge. Additional charges for premium delivery services are not refundable. For partial returns, original delivery charges are normally not refunded unless required by law.
13.7.6 Any permitted deduction for diminished value under clause 13.2.4 will be explained to you.
13.7.7 Your payment provider may take additional time to display the refund in your account.
13.8 Exchanges
For a change of size or product, arrange the return of eligible Goods and place a separate order for the replacement. Remedies for faulty or incorrectly supplied Goods are handled separately under clause 12.
13.9 Statutory rights
Our voluntary returns policy is additional to statutory rights. Nothing in clauses 12–14 excludes or limits rights that cannot lawfully be excluded, including any mandatory consumer protection applicable to an overseas purchase.
14. Account termination and cancellation of pending purchases
14.1 You may close your Account by contacting us using the details in clause 13.4.
14.2 We may close or suspend your Account where reasonably justified, including misuse of the Web Site, suspected fraud or a serious breach of these Terms. We will normally notify you by email and explain the reason, unless doing so would be unlawful or compromise security or an investigation.
14.3 Account closure does not remove rights or obligations relating to purchases already made. Where we close your Account, we will notify you of the status of any pending orders. Any cancellation by us will be subject to our contractual obligations and your legal rights.
14.4 Before accepting an order under clause 4.1, we may decline it and refund any payment taken. Once a contract has been formed, we will not treat Account closure as an unrestricted right to cancel that contract.
14.5 If you close your Account, we will treat this as a request to cancel outstanding, undispatched orders where cancellation is available. Exceptions for genuinely bespoke or personalised Goods remain subject to clause 13.3.
14.6 Where an undispatched purchase is cancelled and a refund is due, we will refund the sums paid for that purchase to the original payment method without undue delay and within 14 calendar days of cancellation.
14.7 Account closure does not prevent you from requesting a return, reporting defective Goods, making a complaint or exercising statutory cancellation rights. Contact us directly using the details in clause 13.4.

20. No waiver
In the event that we fail to enforce rights against you, or delay in doing so, that will not mean that you have waived our rights against you.
